Terms & Conditions

Effective date: 3/14/22

These Terms and Conditions govern your use of magicvalleynotary.com and communications with Magic Valley Notary (“we,” “our,” or “us”). When you arrange services with us, the appointment and service terms presented to you also apply. Please review these terms before submitting an inquiry or requesting an appointment.

Website Use

You agree to use our website lawfully and provide accurate information when contacting us or requesting services. You may not interfere with website security, attempt unauthorized access, submit fraudulent requests, or misuse our content or communication channels.

Inquiries and Appointment Requests

Our services are provided by appointment. Submitting a contact form, requesting a quote, leaving a voicemail, or sending a text does not automatically reserve an appointment or guarantee that a document can be notarized.

An appointment is confirmed only when we agree with you on the date, time, location or remote-session arrangements, and applicable service details. Availability may vary, including evenings and weekends.

Please provide accurate contact information and tell us the general type of service you need. Avoid submitting Social Security numbers, full financial account numbers, identification images, or complete sensitive documents through the general contact form or ordinary text messages. We will discuss an appropriate method for transmitting documents when needed.

Notarial Services and Client Responsibilities

We provide notarial and related signing services within the scope permitted by applicable law. Completion of a notarization depends on satisfying the requirements for the particular notarial act, including appearance, identity verification, and any required oath, acknowledgment, or signature.

Please bring the necessary documents and acceptable identification, and follow the preparation instructions provided for your appointment. Ask us before signing if you are unsure whether the document must be signed in our presence.

We may decline or stop a notarization if legal requirements are not met, identity cannot be satisfactorily established, or other lawful grounds prevent us from proceeding. Scheduling an appointment does not guarantee completion of a notarial act.

No Legal Advice

Our notarial services do not include legal, tax, or financial advice. We do not select legal documents or determine which notarial act you need. If you need help choosing documents, interpreting legal effects, or deciding which certificate or notarial act is appropriate, consult the document’s recipient, the issuing organization, or a qualified attorney.

Notarization does not guarantee that a document is legally enforceable, that its contents are accurate, or that another organization will accept it.

Fees and Payment

We will communicate applicable fees before you agree to services. Depending on the appointment, charges may include notarial fees and separately disclosed travel, printing, scanning, signing, remote-platform, or other service fees, where permitted by law.

Travel and related service charges are separate from the fee for a notarial act. Website pricing is general information; confirm the total for your particular appointment with us. Any change to an agreed price requires your approval before the additional service is provided.

Payment arrangements will be communicated when services are scheduled. Any cancellation, no-show, deposit, or travel-charge conditions must be disclosed and agreed to before they apply. We do not impose undisclosed cancellation penalties through these website terms.

Cancellations and Rescheduling

Please contact us as soon as possible if you need to cancel, change the location, or reschedule an appointment. Alternate arrangements depend on availability. If we need to change or cancel an appointment, we will contact you to discuss available options.

If a notarial act cannot be completed, any charge for travel or other work already performed is governed by the terms disclosed and agreed to before the appointment and applicable law.

Remote Online Notarization

Remote online notarization is available only when we confirm that the requested service can be performed using an authorized process. Participation may require an appropriate device, internet connection, identity verification, electronic documents, and a supported platform.

Remote sessions may involve audio-video recording, electronic signatures, identity-proofing information, and legally required record retention. We will provide applicable instructions and disclosures before proceeding. A telephone call or ordinary text exchange alone does not constitute a remote online notarization.

SMS Appointment and Customer Service Communications

When You Text Us First

When you initiate a text conversation with Magic Valley Notary, you consent to receive replies and related follow-up texts reasonably necessary to address your request. These may include answers to your questions, availability, service quotes, appointment scheduling and confirmation, preparation instructions, reminders for the appointment you arrange, changes, and related customer support.

This consent is limited to your inquiry and the appointment or service arranged through that conversation. It does not authorize recurring promotional messages or unrelated future campaigns.

Contact Form Requests

If you submit our contact form and affirmatively agree to the SMS disclosure presented on that form, you authorize us to text the mobile number you provide about that inquiry and any resulting appointment. Supplying a telephone number without an SMS disclosure and consent action is not treated as blanket permission to send texts.

You may contact us by telephone or another available method if you prefer not to communicate by text. Making a telephone call does not by itself subscribe you to an ongoing SMS program.

Message Types Frequency and Charges

Messages are conversational or informational and relate to the service you requested. Some appointment or service messages may be sent using automated technology. Message frequency varies based on your inquiry and appointment needs. Message and data rates may apply. You are responsible for charges assessed by your mobile carrier.

SMS delivery depends on carrier and network availability and is not guaranteed. Carriers are not liable for delayed or undelivered messages. Please call if an appointment matter is urgent.

Opting Out and Getting Help

Reply STOP to stop text messages or HELP for assistance. You may also call 208-320-4534 or use the contact form on our website to request help or revoke consent. We honor other clear, reasonable requests to stop texts.

You may receive one non-promotional message confirming an opt-out. We will stop further texts covered by your request unless you provide new consent. Opting out of texts does not cancel your appointment. We may communicate necessary appointment information through another permitted channel.

You must own or be authorized to use the number you provide. Please notify us if your number changes or is reassigned.

Marketing Consent

Contacting us, requesting an appointment, submitting a contact form, or receiving a notarial service does not enroll you in SMS marketing. If we offer promotional texts in the future, we will obtain separate affirmative consent before sending them. Marketing consent will not be a condition of obtaining our services.

Intellectual Property and Third-Party Services

Our original website text, graphics, photographs, and branding belong to us or their respective rights holders. You may not reproduce or commercially use protected content without permission, except as permitted by law.

External links and third-party services, including remote-notarization platforms, are subject to their own terms and privacy policies. We are not responsible for third-party practices outside our control.

Website Availability and Liability

We work to keep website information accurate, but errors and interruptions may occur. To the extent permitted by law, website access is provided on an “as available” basis without a guarantee of uninterrupted or error-free operation.

To the extent permitted by law, we are not liable for indirect or consequential losses arising from website use. Nothing in these terms excludes liability that cannot legally be excluded or limits a notary’s statutory duties or accountability for improper notarial acts.

Governing Law and Updates

These terms are governed by Idaho law, subject to applicable mandatory protections. If a provision is unenforceable, the remaining provisions remain in effect.

We may update these terms by posting a revised version and effective date. Updates apply prospectively and do not expand existing SMS consent. Any material change to an agreed service requires any notice or agreement required by law.
