This Privacy Policy explains how Magic Valley Notary (“we,” “our,” or “us”) collects, uses, retains, and shares personal information through magicvalleynotary.com, contact forms, telephone and text communications, appointment scheduling, and notarial services.
Information We Collect
Depending on how you interact with us and the service requested, we may collect:
- Your name, email address, telephone number, and appointment or mailing address.
- Inquiry details, requested services, scheduling preferences, quotes, and appointment records.
- Emails, text messages, form submissions, and related delivery information available from our communication providers.
- SMS consent and opt-out records, including the disclosure presented, consent action, date, and mobile number.
- Information needed to identify signers and perform a notarial act, such as identification details, signatures, and information in relevant documents or notarial records.
- Documents and instructions provided for authorized signing, printing, scanning, or return services.
- Payment and transaction information needed to administer fees. Payment providers handle payment credentials under their own privacy and security practices.
- For remote online notarization, information required by the platform and applicable law, which may include identity-verification results, electronic signatures, audit records, and audio-video recordings.
- Technical information, such as IP address, browser and device information, pages visited, and cookie data, where collected by our website or service providers.
Not every service requires every category of information. Please provide only the information needed for your request. Avoid sending identification images, Social Security numbers, full financial account numbers, or complete sensitive documents through ordinary texts or the general contact form.
How We Use Information
We use information to respond to inquiries, provide quotes, schedule and confirm appointments, send preparation instructions and reminders, perform requested services, verify identity as required, process fees, coordinate authorized document handling, maintain appropriate records, secure our systems, and comply with legal obligations.
We do not treat an inquiry, appointment, or incoming text as permission to send unrelated marketing messages.
SMS Communications and Consent
When you text us first, we use your number and message to reply and provide related follow-up about your inquiry or resulting appointment. The conversation is limited to the service you requested and does not subscribe you to recurring promotional texts.
If you submit a website form and separately agree to its SMS disclosure, we may text you about that inquiry and resulting appointment within the scope of your consent. Providing a phone number without consent does not automatically enroll you in texting.
Messages may include scheduling, confirmations, service quotes, preparation instructions, appointment reminders, changes, and customer support. Some messages may be sent using automated technology. Message frequency varies. Message and data rates may apply.
Reply STOP to stop text messages or HELP for assistance. You may also call 208-320-4534 or use our website contact form to request help or revoke consent. We honor other clear, reasonable opt-out requests. We may send one non-promotional opt-out confirmation.
Opting out does not cancel your appointment. Necessary service communications may be provided through another permitted channel. We may retain consent and suppression records to document your preferences and prevent unwanted messages.
We obtain separate affirmative consent before any SMS marketing enrollment. Consent to marketing texts is not required to obtain our services.
Mobile Information and SMS Consent Protection
Mobile information will not be shared with third parties or affiliates for their marketing or promotional purposes. SMS opt-in data and consent will not be sold, rented, or shared with third parties or affiliates for their own use.
We may provide information necessary to operate our messaging program to service providers acting on our behalf, subject to confidentiality and use restrictions, or disclose information where legally required. Those disclosures do not authorize unrelated marketing.
Sharing Information to Provide Services
We may share necessary information with website hosting providers, communication providers, scheduling providers, payment providers, remote-notarization platforms, and authorized record-storage providers. Providers acting on our behalf may use information only to perform the relevant services, subject to applicable contractual restrictions. Independent providers may also process information under their own policies and legal obligations.
For a signing arranged through a title company, lender, attorney, or other requesting organization, we may exchange the information and documents needed to complete the authorized assignment. We do not share information beyond the authorized service or another lawful purpose.
We may disclose information to comply with applicable law or valid legal process, meet obligations concerning notarial records, investigate fraud or security incidents, or protect legal rights and safety. Information may also transfer in a lawful reorganization or transfer of our operations, subject to applicable protections. Such a transfer does not expand SMS consent.
Notarial Records and Remote Sessions
Notarial records may be subject to legal retention, access, and disclosure requirements. Remote online notarization includes legally required recording and recordkeeping. The applicable platform may retain identity-verification information, session recordings, and audit records according to its policies and legal requirements.
We provide relevant remote-session disclosures before proceeding and retain or arrange retention of records for the required period. A deletion request may not extend to records we are legally required to maintain. This policy does not promise that legally required notarial records will remain confidential against a lawful disclosure requirement.
Cookies and Website Technologies
Our website may use cookies and similar technologies to support site functionality, protect forms, and understand website usage. You can manage cookies through your browser settings and any consent controls provided on the website. Blocking cookies may affect some features.
Optional tracking is subject to consent where required by applicable law. External websites and platforms may have their own tracking practices.
Retention and Security
We retain information for as long as reasonably necessary to provide services, maintain records, resolve disputes, honor messaging preferences, and satisfy legal requirements. Retention periods depend on the information and applicable obligations. Legally required notarial records may be retained longer than ordinary scheduling correspondence.
We use reasonable administrative, technical, and organizational safeguards. No online system or transmission method guarantees complete security. Ask us for an appropriate document-transfer method when sensitive materials are necessary for a service.
Your Choices and Privacy Requests
You may choose telephone communication instead of texting, decline optional SMS enrollment, or revoke texting consent. You may contact us to request access to, correction of, or deletion of personal information. We respond as required by applicable law and may verify your identity before completing a request.
Rights vary by location and applicable law. We may retain information needed for notarial recordkeeping, other legal obligations, transaction records, fraud prevention, or opt-out compliance. Corrections to official notarial records must follow applicable requirements.
Children’s Privacy
Our website is intended for a general audience and is not directed to children under 13. We do not knowingly collect personal information online directly from children under 13 without legally required parental consent. If services involve a minor, contact us to discuss applicable requirements. If you believe a child has submitted information contrary to this policy, contact us so we can investigate.
Third-Party Services and Policy Changes
Third-party websites and platforms operate under their own privacy policies. This policy describes our practices and does not govern providers outside our control.
We may update this policy and will post a revised effective date. We provide additional notice or obtain consent when required by law. Updates do not retroactively expand the scope of SMS consent.
